Waiver of Liability, Release, Assumption of Risk and Indemnity Agreement
For and in consideration of my registration with the Pittsburgh Urban Magnet Project (“PUMP”) and being allowed to participate in any program, event or activity sponsored by PUMP, (including but not limited to: the Pittsburgh Sports League (“PSL”) competitions, service projects, Kickball for a Cause, Steel City World Cup, Yoga in the Park, self-defense training programs, fundraising events, and corporate sporting events and tournaments, and any other event, competition or program sponsored by PUMP, each of which is hereinafter known as a “Program” and known collectively as “Programs”), I hereby forever waive, release, discharge and relinquish for myself, and my heirs, administrators, successors and assigns, any and all claims, rights, actions, suits or causes of action against PUMP, PUMP’s sponsors, other Program participants, coaches, officials and owners of the various sites of Programs (hereinafter collectively referred to as “Releasees”) for personal injury, property damage, wrongful death or any other type of injury or damages arising out of my participation in Programs, and/or any activities incidental thereto, including transportation to and from PSL competitions, whenever or however they may occur or arise.
I fully understand and acknowledge that a Program may involve risks and dangers to my person including bodily injury, partial or total disability, paralysis, and death, and damages which may arise therefrom and I acknowledge and voluntarily assume all such risks and dangers in connection with my participation therein. I further understand and acknowledge that these risks and dangers may be caused by my own negligence or the negligence of others and I knowingly and voluntarily assume all such risks and dangers whether caused by my own negligence or the negligence of others. I further acknowledge that there may be risks and dangers that are not known to PUMP or myself or are not reasonably foreseeable at this time and I voluntarily assume all such risks.
I covenant and agree not to sue the Releasees, or any of them, for or on account of any injury or damages I may suffer in connection with my participation in a Program, and further agree that if any person or entity brings any claim or lawsuit for personal injury, property damage, wrongful death, subrogation or any other cause of action against Releasees related to any injury or damages I may suffer in connection with my participation in a Program, I shall defend, indemnify and hold harmless Releasees from any and all such claims or causes of action by whomever or wherever made or presented.
I represent and warrant that I am in good health, physically fit and in proper physical condition to participate in Programs, and that I have had the opportunity to seek the advice of my personal physician prior to participating therein. I further represent and warrant that I am at least eighteen (18) years old; provided, however, that if this registration is for participation in a Program at a licensed site where alcoholic beverages are served, I represent and warrant that I am at least twenty-one (21) years old.
I HAVE READ THIS WAIVER OF LIABILITY, RELEASE, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING IT. I HAVE SIGNED THIS AGREEMENT FREELY AND WITHOUT PROMISE OR INDUCEMENT EXCEPT AS SET FORTH HEREIN. THE RELEASE, WAIVER, ASSUMPTION OF RISK AND INDEMNITY HEREIN ARE INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED BY LAW, AND TO BIND MYSELF AND MY ESTATE. IF ANY PORTION HEREOF IS HELD TO BE INVALID, I AGREE THAT THE BALANCE SHALL NOTWITHSTANDING CONTINUE IN FULL FORCE AND EFFECT. THIS AGREEMENT SHALL BE GOVERNED BY PENNSYLVANIA LAW, AND THE VENUE FOR ANY LITIGATION ARISING WITH RESPECT HERETO SHALL BE EXCLUSIVELY IN THE COURT OF COMMON PLEAS OF ALLEGHENY COUNTY, PENNSYLVANIA.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic, a global health
emergency, by the World Health Organization. COVID-19 is extremely contagious and is
believed to spread mainly through person-to-person contact. As a result, federal, state, and local
governments, and federal and state health agencies, including the Centers for Disease Control
and Prevention (CDC), recommend social/physical distancing and have, in many locations,
prohibited the congregation of large groups. These agencies are recommending additional health
practices and sanitary/disinfecting procedures to stop the spread of the virus.
The Pittsburgh Parks Conservancy is responding to COVID-19 concerns by following these
guidelines and precautions, including asking for a health history review from all guests and
attendees. However, the Parks Conservancy cannot guarantee that you or a member of your
group will not become infected with COVID-19. Further, visiting a Parks Conservancy facility or
attending a Conservancy program or event could increase your risk, or the risk of others in your
group, of contracting COVID-19. We are asking all guests and attendees to help us prevent the
transmission of the virus.
Symptoms of COVID-19 include:
• Fever
• Chills
• Fatigue
• Dry Cough
• Difficulty Breathing
• Loss of Taste
• Loss of Smell
I agree to the following:
• I understand the above symptoms and affirm that I, as well as all household members, do
not currently have the symptoms listed above, nor have experienced them within the past
14 days.
• I affirm that I, as well as all household members, have not been diagnosed with COVID-19
within the past 30 days.
• I affirm that I, as well as all household members, have not knowingly been exposed to
anyone diagnosed with COVID-19 within the past 30 days.
• I affirm that I, as well as all household members, have not traveled outside of the country
or to any region considered to be a ‘hot spot’ for COVID-19 infections within the past 30-
days.
• I affirm that I am following all CDC recommended guidelines as much as possible and
limiting my exposure to the coronavirus/COVID-19.
• I affirm that I will inform the Parks Conservancy should I develop COVID-like symptoms
within 14 days of visiting a Parks Conservancy facility or attending a Parks Conservancy
event or program.
I understand that the Parks Conservancy and the City of Pittsburgh cannot be held liable for any
exposure to the COVID-19 virus caused by misinformation on this form or the health history
provided by each guest or attendee.
The Parks Conservancy has increased its sanitary/disinfecting procedures in compliance with CDC
guidelines to include multiple facility and equipment cleanings a day. We ask guests and
attendees to follow these enhanced procedures, as well, to help prevent the spread of COVID-
19:
• We are asking all guests and attendees to agree to a temperature check prior to entering
a facility or participating in a Parks Conservancy program or event.
• We are asking anyone who has a temperature of 100.4 or higher during the temperature
check to immediately leave the premises.
• We are asking all guests to wash their hands before leaving home or sanitize their hands
prior to entering a facility or attending a Parks Conservancy program or event.
• We are asking all guests and attendees to practice safe social/physical distancing
protocols at all times.
• We are asking all guests to wear masks or face coverings while inside a facility or while
participating in a Parks Conservancy program or event.
• We are asking those guests who, for health reasons, cannot wear a mask while visiting a
facility or attending a program or event to be especially aware of proper social/physical
distancing protocols. Please remain with your group and keep at least six feet from other
individuals.
• Please avoid touching surfaces.
• Please wash or sanitize your hands frequently.
• Please cough and sneeze into a tissue or the crook of your arm.
• Please avoid touching your face with your hands.
• Please avoid all physical contact with other guests or participants, including handshakes
and hugs.
I acknowledge the contagious nature of the coronavirus/COVID-19 and further acknowledge that
the Pittsburgh Parks Conservancy has put into practice preventative measures to reduce the
spread of the coronavirus/COVID-19. I further acknowledge that the Parks Conservancy cannot
guarantee that I will not become infected by coronavirus/COVID-19.
By signing below, I release the Pittsburgh Parks Conservancy and the City of Pittsburgh from all
liability for unintentional exposure or harm due to coronavirus/COVID-19.
